H2B Fate In Hands of a Federal Judge, For Now

ANLA and state association partners have supported lawsuits brought by the U.S. Chamber of Commerce, PLANET, and other allies against the U.S. Department of Labor (DOL) H-2B wage and program rules in the Northern District of Florida. As reported previously, on April 26, Judge Rodgers issued a preliminary injunction preventing the DOL from implementing the programmatic rule. The ruling will also impact DOL’s plans to implement the wage rule on October 1. While the ruling was in Florida, the decision applies nationwide. This is a huge victory for the entire green industry.

On May 17th, Congressman Rodney Alexander (R-LA), along with 37 additional Members, sent a letter to Labor Secretary Solis expressing bipartisan and bicameral opposition to the wage and programmatic rules. The letter urged DOL to withdrawal both pending H-2B rules.
