Congress On Spending, H2B

ANLA is happy to announce that this past weekend, before heading home to campaign, Congress did manage to pass a stop gap spending measure to keep the government funded beyond the start of fiscal 2013, which begins October 1. The spending measure has the practical effect of also extending, through March 27, 2013, the law that prevents the US Department of Labor (DOL) from implementing the H-2B wage rule. While the solution is not permanent, H-2B employers will not face unprecedented wage increases for at least another six months.

ANLA also continues to support litigation to prevent DOL from implementing both the H-2B wage and program rules. The program rule has been blocked due to a preliminary injunction issued by Judge Rodgers in the Northern District of Florida. After the legal maneuverings in the case conclude, ANLA hopes that the judge will make the injunction permanent.
